This Privacy Policy describes Fiberlink’s use of personally identifiable information about customers and potential customers obtained via this Site, or when you use our products and services.

Due to the Internet's rapidly evolving nature, Fiberlink may need to update this Privacy Policy from time to time.  If we change the way in which we collect or use your personally identifiable information, Fiberlink will post a prominent change notice with its updated Privacy Policy on our Site located at www.fiberlink.com and we may send registered users notice of the change..  Fiberlink encourages you to review this Privacy Policy regularly for any changes so that you are aware of what personally identifiable information we may collect and how we may use this information.  Your continued use of this Site and/or continued provision of personally identifiable information to us will be subject to the terms of the then-current Privacy Policy.

Information Collection and Use

You can generally visit our Site without revealing any personally identifiable information about yourself.  However, in certain sections of this Site we may invite you to submit questions or comments.  Due to the nature of some of these activities, we may ask that you complete and submit an online form with personally identifiable information such as your name, username, password, email address, phone number, and other contact information.  We also may collect the foregoing personally identifiable information from our sales department when you have indicated an interest in our services or have requested a test or demonstration.  We also may collect your username, email address and domain name through your use of our products and services.

We use your personally identifiable information to deliver certain services, products or information you have requested and to follow up on such requests, verify your authority to enter certain password protected areas of the Site, send you notices and communications for products and/or services that you have used or that may be of interest to you to improve the content and general administration of the Site, or for transactional purposes.  This may include newsletters, product updates, event announcements, and promotional offers.  Our third party service providers may contact you for the purposes described in this paragraph.

On our behalf, we also use a marketing automation company as a third party service provider to collect your information when you request a demo, sign up for a conference, and request more information.  This third party collects your personally identifiable information and shares it with us so we can provide you with the services and communications described above.  They do not sell or use your personally identifiable information for any other purpose than to respond to our requests. If you choose to use our referral service to tell a friend about our Site, we will ask you for your friend’s name and email address.  We will automatically send your friend a one-time email inviting him or her to visit the site.  Fiberlink does not store this information.

This web site contains links to other sites that are not owned or controlled by Fiberlink. Please be aware that we, Fiberlink, are not responsible for the privacy practices of such other sites.  We encourage you to be aware when you leave our site and to read the privacy statements of each and every web site that collects personally identifiable information. This privacy statement only applies to information collected by this web site.

We track, through our Site or through the use of our products and services, the total number of visitors to our Site, the number of visitors to each page of our Site, IP addresses, External Web Sites (defined below) linked to, browser type, domain names, time and date stamp, referring URL, landing page and information about the hardware and software that you use (such as your computer or machine name), and we may analyze this data for trends and statistics in the aggregate and as linked with your personally identifiable information.  We may use such information to analyze trends, administer and improve the Site and our services, track users' movement, and gather broad demographic information for aggregate use.

The authorized registered user will be able to view through MaaS360 all of the usernames and passwords of the company employees that have used Fiberlink’s services and other identifiable information about use of the company’s equipment and network, such as duration of use and applications used.  Registration for an account must be done off-line with your account representative.

Cookies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on this site. We do not link the information we store in cookies to any personally identifiable information you submit while on our site.

We use session ID cookies.  We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close you browser.

We use a third-party tracking service that uses cookies to track non-personally identifiable information about visitors to our site in the aggregate usage, paths, page clicks and downloads to understand how users are traveling through the site.

Children's Privacy

Fiberlink recognizes the privacy interests of children and we encourage parents and guardians to take an active role in their children's online activities and interests.  This Site is not intended for children under the age of 13 and we endeavor not to collect any personally identifiable information from children under the age of 13.  Fiberlink targets its services and this Site to adults and not to children under 13. 

Disclosure

We may provide your personally identifiable information that we collect to the service providers that we may engage to assist us.  For example, we may provide your personally identifiable information to an organization in order to complete a service (e.g., send you our newsletter) or to an entity that follows up on customer requests for information.  We restrict by contract such third party entities from further distributing your personally identifiable information and from using your personally identifiable information for commercial purposes unrelated to your provision of the information to us.

Security

We may employ procedural and technological measures, consistent with industry practice.  Such measures are reasonably designed to help protect your personally identifiable information from loss, unauthorized access, disclosure, alteration or destruction.  Fiberlink may use encryption, secure socket layer, firewalls, physical lock and key, internal restrictions, password protection and other security measures to help prevent unauthorized access to your personally identifiable information.

Correction/Updating Personally Identifiable Information

Dispute Resolution

Fiberlink participates in the EU Safe Harbor Privacy Framework as set forth by the United States Department of Commerce.  As part of our participation in the safe harbor, we have agreed to TRUSTe dispute resolution for disputes relating to our compliance with the Safe Harbor Privacy Framework. If you have any complaints regarding our compliance with the Safe Harbor you should first contact us (as provided above). If contacting us does not resolve your complaint, you may raise your complaint with TRUSTe by Internet at http://www.truste.org/consumers/watchdog_complaint.php, fax at 415-520-3420, or mail at Watchdog Complaints, TRUSTe 55 2nd Street, 2nd Floor, San Francisco, CA, USA 94105. If you are faxing or mailing TRUSTe to lodge a complaint, you must include the following information: the name of company, the alleged privacy violation, your contact information, and whether you would like the particulars of your complaint shared with the company. The TRUSTe dispute resolution process shall be conducted in English.  For human resources data we have agreed to cooperate with Data Protection Authorities. Any questions, comments or complaints about the data practices (including without limitation compliance with data privacy principles of notice, choice, onward transfer, access, security, data integrity, or enforcement) of a hosted online OnBoarding software customer or partner for whom Fiberlink processes data should be addressed to that customer or partner.

Acceptable Use Policy

This Acceptable Use Policy governs the use of any software or services obtained from Fiberlink Communications Corp. by any person (“End User”).  End User acknowledges that the software and its structure, organization, source code, and protocols constitute valuable and proprietary trade secrets and other proprietary intellectual property of Fiberlink and its suppliers. Accordingly, End User agrees not to: (a) modify, adapt, alter, translate, or create derivative works from the software; (b) merge the software with any other software, products or services; (c) sublicense, resell, re-distribute, lease, rent, loan, disclose or otherwise transfer the software or any other associated products and services to any third party; (d) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source or object code of the software; (e) use the software to provide any facility management, service bureau or similar services to third parties, permit third parties to remotely access and use the software or use or permit any software to be used, or to develop a product line that is similar to the software; (f) publish or share with any third party any results of any benchmark or performance tests run on the software or component thereof; or (g) otherwise use or copy the software except as expressly allowed in a written services agreement or other agreement by Fiberlink.  In addition, End User agree that it will not use the software or services to take any action that: (i) violates any applicable law or regulation or is legally libelous, defamatory, indecent, obscene or pornographic; (ii) would violate copyright, trademark, trade secret or other property right of any third party; or (iii) interfere with other users’ use of the software or of the Internet; (iv) involves the addition, removal or modification of identifying network header information in an effort to deceive; (v) uses the software to access, or attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Fiberlink's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data; (vi) uses the software to collect, or attempt to collect, personal information about third parties without their consent.  Any questions should be directed to Lisa Coleman in the Fiberlink Legal Department, lcoleman@fiberlink.com
